Edo Tribunal Upholds Gov Okpebholo’s Election, Dismisses AA’s Petition

The Edo State Governorship Election Petition Tribunal in Abuja has dismissed a petition by the Action Alliance (AA) challenging the election of Governor Monday Okpebholo.

A three-member panel, led by Justice Wilfred Kpochi, ruled that the petition filed by AA and its National Chairman, Adekunle Rufai Omoaje, was without merit. The tribunal determined that the case involved pre-election issues, which fall outside its jurisdiction.

AA alleged that the Independent National Electoral Commission (INEC) unlawfully excluded its rightful candidate from the September 21, 2024, governorship election. The party claimed that, despite multiple court rulings, INEC recognized a candidate who was not validly nominated. They argued that the electoral body’s failure to list their legitimate candidate constituted a violation of Section 134(1)(b) of the Electoral Act.

The petitioners also contended that Governor Okpebholo of the All Progressives Congress (APC) did not secure the majority of valid votes and alleged electoral malpractice. They sought the annulment of the election, but the tribunal rejected their request.

Upholding all preliminary objections raised by the respondents, including INEC and Governor Okpebholo, the tribunal ruled that AA’s National Chairman lacked the legal standing to bring the case since he did not participate in the election. Additionally, it held that the petition was time-barred, as it addressed pre-election matters outside the tribunal’s jurisdiction.

Notably, AA’s candidate, Tom Iseghhi-Okojie, withdrew from the race shortly before the election and endorsed Governor Okpebholo.

With this ruling, Governor Okpebholo’s victory remains intact, affirming his mandate as the duly elected governor of Edo State.
